Types of Information My Firm Collects

My firm, including my employees and agents, collects, uses and discloses certain personal information about you only when that type of information is provided by you or is obtained by me with your authorization which may, in some circumstances, be implied. I use personal information to prepare your personal income tax returns and to provide various tax and financial planning services to you at your request.

Examples of sources from which I may collect, use and disclose personal information include:

  • Interviews and phone calls with you
  • Letters or emails from you
  • Tax return or financial planning organizers
  • Financial history questionnaires
  • Discussions with your professional advisers such as lawyers and financial planners

Parties to Whom My Firm Discloses Information

As a general rule, I do not disclose information about any of my clients orformer clients to anyone. However, to the extent permitted by or required by applicable laws and any applicable Code of Professional Conduct, certain nonpublic information about you may be disclosed in various situations including:

  • Compliance with a validly issued and enforceable subpoena, summons or similar judicial proceeding.
  • In the course of a review of my firm’s practices under the authorization of a provincial or federal licensing board, or as necessary to properly respond to an inquiry or complaint from such a licensing board or organization.
  • In the event of a prospective purchase, sale, or merger of my firm, provided that we, including my agents, take appropriate precautions (for example, through a written confidentiality agreement) so the prospective purchaser or merger partner does not disclose information obtained in the course of the review.
  • As a part of any actual or threatened legal or alternative dispute resolution proceedings including those initiated by or against myself, provided we disclose only the information necessary to file, pursue, or defend against the lawsuit and take reasonable precautions to ensure that the information disclosed does not become a matter of public record to the extent possible.
  • To provide information to affiliates of my firm and nonaffiliated third parties who perform services or functions for us in conjunction with our services to you, but only if I have a contractual agreement with the other party that prohibits them from collecting, disclosing or using the information other than for the purposes for which it was disclosed. (Examples of such disclosures include engaging a records-retention agency to store prior year records.)

Use of Personal Information

I use personal information collected under this Policy to perform services within the scope of my engagement. I also use it to provide you through various channels with information that I believe will be of interest to you. This includes such manners as:

  • New services I provide
  • Notice of changes in the law or accounting practices that may be of interest to you, and
  • Other professional or business developments.

If you do not wish to receive such information, you may opt out by sending an email to ibertani@ib-ca.com or by advising me and I will discontinue sending you information other than in regard to your account.

Confidentiality and Security of Personal Information

Except as otherwise described in this notice, I restrict access to nonpublic personal information about you to employees of my firm and other parties who must use that information to provide services to you. Their right to further disclose and use the information is limited by the policies of my firm, applicable law, my Code of Professional Conduct, and nondisclosure agreements where appropriate. I also maintain physical, electronic, and procedural safeguards in compliance with applicable laws and regulations to guard personal information from unauthorized access, alteration, or premature destruction.
